Afraid of losing time with your kids?

Mothers are often pressured to accept 50/50. Fathers are often told they can't win. Illinois law says neither: there is no presumption in favor of either parent, and every decision turns on your child's best interests.

01

Decision-making covers four areas

Courts allocate authority over education, health care, religion and extracurricular activities, jointly or to one parent.

02

Parenting time is separate

Parenting time, formerly visitation, is decided separately from decision-making, and each can be changed separately.

03

Moves have hard limits

Moving a child more than 25 miles from home in Cook, DuPage, Kane, Lake, McHenry or Will County needs the other parent's written consent or the court's approval.

Know what the judge looks at

Full custody, joint custody and parenting time: what a Chicago child custody lawyer will tell you.

These are the rules that decide parenting time and decision-making in Illinois.

There is no “full custody” label

Illinois allocates decision-making and parenting time. You can ask for sole decision-making in one or more areas and a schedule that gives you the majority of parenting time.

Shared or sole decision-making

Decision-making can be shared or given to one parent. Sole decision-making may fit when high conflict keeps parents from deciding together.

Never married? You have rights too

Parentage cases decide parental responsibilities and parenting time for parents who were never married.

Emergencies can be heard fast

An emergency motion asks the court for immediate relief when irreparable harm may occur, and Illinois courts may hear it on an expedited basis.

Common questions

Answers, not asterisks.

Child custody questions parents ask a Chicago custody lawyer first.

Is custody 50/50 in Illinois?
Not automatically. Illinois has no automatic 50/50 rule. The court allocates parenting time and decision-making based on your child's best interests, and there is no presumption in favor of either parent.
How do I get full custody in Illinois?
Illinois doesn't use the term full custody. You can ask the court for sole decision-making in one or more areas and a parenting schedule that gives you the majority of parenting time, and the court decides based on your child's best interests.
How do I apply for joint custody?
You ask the court to allocate parental responsibilities and present a proposed parenting plan. Joint decision-making works when parents can cooperate and communicate about major decisions.
Does the court favor mothers or fathers?
No. There is no presumption in favor of either parent. Courts evaluate each case individually based on the child's best interests.
What can I do when the other parent breaks the custody agreement?
We can ask the court to enforce the parenting time order, and to modify it when the violations show the plan no longer serves your child.
Can my ex move away with our child?
Not without your written consent or court approval if the move qualifies as relocation, such as more than 25 miles from home in Cook, DuPage, Kane, Lake, McHenry or Will County.
We were never married. Can you help?
Yes. We handle parentage cases, which decide parental responsibilities and parenting time for parents who were never married.
Does my child get a say?
Courts may consider a mature child's wishes, but the decision rests on the child's best interests.
Can a parenting plan be changed later?
Yes, after a substantial change in circumstances. Courts are particularly cautious about changing an allocation order entered within the past two years unless there are serious endangerment concerns.
